Trenton Makes, Trial Lawyers Take

July 3, 2008

Remember the old joke: Why does a man hit his head against a brick wall? Because it feels good when he stops.

By this standard, politicians in New York State and New Jersey make this guy look like a genius.

Lawrence J. McQuillan of the Pacific Research Institute and Gregg M. Edwards of the Center for Policy Research of New Jersey note in a strongly reasoned piece that monetary losses from New York and New Jersey are greater than virtually anywhere else. Both states are in the top five nationally for the number of civil suits per 100,000 residents, with the third- and the fourth-riskiest tort litigation systems in the country.

Large corporations, fearful of appeal bonds in the billions, are leaving New York. New Jersey’s economy grew half as fast as the nation’s. In Texas, where comprehensive lawsuit reform was passed, the economy is booming.

I support honest and fair –, I repeat HONEST AND FAIR lawsuit reform -, but based on my experience with big business, banks, credit card corporations, unscrupulous merchants –, and the lawyers in general –, I am quite certain of one thing. When “lawsuit reform” is enacted it swings the “pendulum to the opposite extreme” replacing the “lawyer’s license steal” with the “corporate crooks, corporate attorney’s , predator creditor’s and unscrupulous merchant’s license to steal” with no fear of accountability or consequences”. I don’t know how “comprehensive” Texas lawsuit reform was but I am certain of one thing. The public interest was NOT a factor in that reform and thus the public reaped little if any real benefit or protection from that reform. Big business, unscrupulous merchants and predator creditor banks, credit card corporations etc etc. have repeatedly demonstrated that many of them are just as unscrupulous, treacherous and greedy as the lawyers are. The only difference is they aren’t “armed and fused” with a law degree and a “black robed buddy on the bench”. Entrapping millions of struggling poor, low and middle income Americans between these two powerful -, unprincipled and predatory -, politically and legally protected “Special interest” entities -, both of whom fleece and bilk the electorate at will -, is a key triggering force of contempt for the law and violation of the law -, including rage driven violence.
