“Merit” Selection Mess Continues in Tennessee

Three of the five “special” Supreme Court justices selected by Tennessee Governor Bill Haslam to decide the constitutionality of the state’s “merit” selection system are stepping down after questions were raised about their impartiality. The “special” court members were appointed after all five “regular” Supreme Court justices recused themselves from a lawsuit filed by Tennessee attorney John Jay Hooker arguing that “merit” selection does not meet the Constitution’s requirement that judges be “elected by the vote of the people.”
