Lawyers in New Jersey

New Jersey is one of the top-ranking states in the entire country in terms of lawyer concentration. As per the latest available figures, the total number of active resident lawyers in the state is more than 41,000. For every 10,000 people, the state of New Jersey has 46 lawyers. The ranking of the state on the parameter of lawyers per capita is seven. 

The New Jersey Court System consists of the Supreme Court, the appellate division, the tax courts, the municipal courts, and the county courts. There is a total of 15 county courts in the state. The municipal courts of New Jersey are the most popular nodal centers through which the maximum share of the state population access the legal system. Although the municipal courts in the state are seen as courts of limited jurisdiction, these are the courts that deal with some of the most commonplace cases that happen in someone’s daily life. These cases include cases relating to motor vehicles and parking tickets, minor criminal offenses such as simple assault or bad checks, violation of municipal ordinances, fish, and game cases. 

Serious criminal cases, including cases relating to robbery, auto-theft, serious assault, etc. are initially filed in the municipal courts. However, soon these cases are transferred to the Superior Courts. The superior courts are generally located at the county courthouses.

New Jersey has separate tax courts. It is also an establishment of limited jurisdiction. Judges of the tax court preside over the cases of tax decisions initially conducted by the County Boards of Taxation. The primary purpose of the tax courts in the state is to expedite the judicial review of tax assessments effectively and efficiently. These courts also serve the purpose of streamlining the process to make tax laws more predictable and consistent.  On average, the tax courts in New Jersey handle a total of 15,000 cases per year. 

As is the norm, the Supreme Court of New Jersey is the highest appellate court in the state. Litigants who want the intervention of the Supreme Court in their cases have to file a petition. Upon reviewing the petition, the Supreme Court will only take up the case if it thinks that the legal issues involved in the case are of immense importance to the public. Otherwise, for the Supreme Court to take up a case, the issues involved in the case must be the subject of conflicting decisions delivered by the appellate divisions. 

Like most other states in the country, the New Jersey judiciary also has provisions for a lawyers’ fund for client protection. Clients who have undergone a financial loss due to the dishonest conduct of their attorneys can claim reimbursements from this fund. The New Jersey judiciary also has a specific code of judicial conduct. To keep track of whether the attorney’s conduct is as per the guidelines set by the judiciary, there is the office of attorney ethics. There is also the disciplinary review board and a well-specified set of professional conduct rules that ensure that the state attorneys do everything as per the guidelines set by the judicial branch of the state.
