Lawyers in Iowa

The Judiciary in Iowa deals with a variety of cases including cases relating to a dispute in contracts, family matters, a dispute among landowners and tenants, criminal violations, claims against personal injury, property condemnation issues, and matters related to employment and assertion of constitutional rights.

The judiciary of Iowa has four segments: the Supreme Court of Iowa, the court of appeals, the district courts, and the juvenile courts. The legal workflow in the state starts from the district courts. People disagreeing with the decisions of the district courts can move to the next higher segment, known as the appellate court. The appellate court reviews the decision delivered in the district court. If the litigant disagrees with the judgment pronounced by the court of appeals, he or she may seek further review in the Supreme Court.

Apart from reviewing the judgments and decisions delivered by the lower courts, the Supreme Court of Iowa also promulgates the rules of procedure and practice that are followed by the lower courts throughout the state. The Supreme Court of Iowa also bears the responsibility of overseeing the functioning of the judicial officers and employees of the court.

The juvenile courts were set up in the state as a specialized court that would look after cases involving the children of the state. Types of cases heard in these courts include cases relating to abuse of children, abandonment, and neglect of children, and delinquency cases.

According to the latest data available, the number of active lawyers in the state of Iowa is more than 7,450. Last tabulated, the state ranks at number 44 among all US states in terms of the number of lawyers per 10,000 residents. The state has almost 24 active resident lawyers per 10,000 residents.

The active attorneys of Iowa need to file annual reports. The first one is the CLE report which stands for continuing legal education. The second one is the CSE report, otherwise known as the Client Security Report.  A resident attorney is required to file a CLE report to attest to the fact that he or she has successfully attended the hours required for continuing legal education. The CSE deals with issues about administrative matters such as designated successors and trust accounts.

As a mandatory requirement, the attorneys of Iowa require to complete 15 hours of learning each year. In each subsequent second year, the attorney must invest at least three hours to learn more about legal ethics.

Apart from the mandatory CLE requirement, the attorney can also avail a certificate of good standing from a supreme court clerk paying a fee of 10 dollars. For practicing in the state on behalf of out-of-state companies, the letterhead and publications of the law firm should indicate the lawyers’ license status about which states the lawyer is eligible to practice in. As far as the Supreme Court of Iowa is concerned, it does not issue licenses for law firms. It only licenses individual lawyers.
